Terms of Service The Bikademy website, mobile applications, and services (collectively, the “Services”) are provided by Bikademy d.o.o., located at Naselje Slavonija I 4/5, 35000 Slavonski Brod, Croatia. These Terms of Service (the “Terms”) and the Bikademy Privacy Policy (the “Privacy Policy”) govern your use of the Services. More information about our Services can be found at https://bikademy.com.
By accessing, using, uploading, or downloading any information or materials from the Services, or by creating an account, clicking “Sign Up,” or any similar action, you agree to comply with these Terms. If you do not agree to these Terms, do not access or use the Services. This agreement is written in English. If there is a conflict between a translated version of the Terms and the English version, the English version prevails.
If you use the Services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms. If you lack such authority, you may not access or use the Services. These Terms include disclaimers of warranties and limitations on liability.
Dispute Resolution These Terms include provisions that govern how disputes between you and Bikademy are resolved, including an agreement to arbitrate, which will, unless you reside in the European Union, require you to submit claims to binding arbitration and limit you to individual claims, unless you opt-out according to the instructions below.
Registration and Accounts The Services are intended for individuals 13 years or older, or the legal age required in your country to use the Services. If you are under the legal age to form a binding contract, your parent or legal guardian must review and agree to these Terms on your behalf.
To use the Services, you must register and agree to: (a) Provide true, accurate, current, and complete information about yourself (“User Data”). (b) Maintain and promptly update your User Data.
You agree to create only one personal account and not to share your account or details with others. If you provide inaccurate User Data or create multiple accounts, Bikademy may suspend or terminate your account. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
GDPR Compliance To use all functions of the Bikademy mobile app, you must register and provide the following mandatory information:
- Email address
- Username
- Password
- Authorization token
Your registration data is necessary to create and manage your user account. By providing this data, you consent to its processing as per Art. 6 Para. 1 lit. b GDPR.
You may also provide additional voluntary information, such as a profile photo. This information is optional and may be visible to other users according to your settings. Your IP address will be temporarily saved to detect and prevent potential attacks and misuse. Data is stored for a maximum of 90 days before being anonymized.
Live Tracking If you use the Tracking feature, your location data will be sent to our API at regular intervals. This data is essential for providing the service and improving cycling activities and recommendations.
Data Processing for Exercising Your Rights We process personal data transmitted by you when exercising your rights under GDPR. This processing is based on Art. 6 (1) (c) GDPR and is stored for up to three years to provide and document evidence.
Content and Conduct You retain ownership of the content you make available through the Services. You grant Bikademy a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your content. This license ends when you delete your content or account.
You are responsible for the content you upload and agree not to post any content that violates these Terms. Bikademy does not routinely screen user content but reserves the right to remove any content that violates these Terms or is objectionable.
Third Parties Bikademy is not responsible for third-party products and services available through the Services. Any interactions or transactions with third parties are solely between you and the third party. Bikademy is not liable for any loss or damage resulting from your dealings with third-party service providers.
Electronic Communications The Services may provide the ability to send messages through various communication methods. You agree to use these methods only for their intended purposes and acknowledge that communications may be public. Bikademy is not responsible for communications with third parties unless expressly stated otherwise.
Proprietary Rights The Services and all related software contain proprietary information protected by intellectual property laws. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services without Bikademy’s permission. Bikademy grants you a non-exclusive license to access and use the Services.
Claims of Infringement If you believe that material on the Services infringes your copyright or trademark, you may send a notice to Bikademy requesting its removal. Notices must meet the requirements of the DMCA.
Your Feedback By providing feedback, you grant Bikademy a license to use and exploit such feedback.
Disclaimer of Warranties and Liability The Services are provided “as is” without warranty. Bikademy disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Bikademy is not liable for any damages arising from your use of the Services.
Termination Bikademy may suspend or terminate your account for serious violations of the Terms or other circumstances. Upon termination, you must stop using the Services, and certain provisions of the Terms will survive.
General These Terms constitute the entire agreement between you and Bikademy. Bikademy reserves the right to modify the Terms and the Services at any time. By continuing to use the Services after changes are made, you agree to the updated Terms.
